By accessing our website, requesting a site assessment, signing a proposal, or purchasing any products or services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Our Services
AC Bio Clean provides probiotic-based HVAC coil cleaning, maintenance plans, site assessments, and related products (e.g., 216oz concentrate bottles and sprayers) for hotels, restaurants, commercial properties, multifamily buildings, and other clients, primarily in South Florida and expanding regions.
- Service Plans: Include initial deep cleans and quarterly (or other frequency) probiotic maintenance.
- Self-Serve Products: Sold for in-house application.
- All services and proposals are custom based on site assessments.
2. Proposals and Agreements
- Proposals are valid for 14 days unless otherwise stated.
- A signed proposal, purchase order, or payment confirmation constitutes a binding agreement.
- We reserve the right to adjust pricing or scope if site conditions change significantly from the assessment.
3. Pricing and Payment
- Pricing is as quoted in the proposal or listed on the website for self-serve products.
- Payments are due as specified (e.g., upfront for initial services, net 30 for approved accounts, or via Stripe for subscriptions/products).
- We accept major credit cards, ACH, and checks. A service/credit card fee may apply.
- Late payments may incur 1.5% monthly interest and may result in suspension of services.
4. No Returns / No Refunds Policy
All sales are final. There are no returns, refunds, cancellations, or credits for services performed or products purchased.
- Services: Once a cleaning service (initial deep clean or quarterly visit) has been scheduled and/or completed, it is non-refundable. This includes labor, travel, materials, and any documented results delivered.
- Products: Concentrate, sprayers, and all self-serve items are non-returnable due to their specialized nature and regulatory considerations.
- Exceptions: Only at our sole discretion for extreme cases (e.g., proven delivery damage with photographic evidence prior to use). No refunds for change of mind, unused product, or dissatisfaction after application.
- This policy ensures we can maintain the highest standards of service, materials, and scheduling reliability for all clients.
5. Scheduling, Cancellations, and Rescheduling
- You must provide at least 48 hours’ notice for cancellations or rescheduling.
- Cancellations with less than 48 hours’ notice or no-shows may incur a cancellation fee of up to 50% of the service value.
- We will make reasonable efforts to accommodate your preferred dates, but availability is not guaranteed.
6. Performance and Limited Warranty
- We warrant that services will be performed in a professional manner using our proprietary probiotic formula.
- Results vary based on equipment condition, environment, usage, and maintenance. We do not guarantee specific energy savings percentages, as these depend on multiple variables (documented case studies are for illustration only).
- No other warranties, express or implied, including merchantability or fitness for a particular purpose.
- Our sole remedy is re-performance of the service at our discretion. We are not liable for indirect, consequential, or incidental damages.
7. Limitation of Liability
To the fullest extent permitted by law, AC Bio Clean’s total liability shall not exceed the amount paid by you for the specific service or product in question. We are not liable for:
- Pre-existing equipment damage
- Downtime or business interruption
- Third-party claims
- Force majeure events (hurricanes, etc.)
8. Intellectual Property
All content on our website, proposals, marketing materials, ROI calculators, and branding is owned by AC Bio Clean. You may not reproduce, modify, or distribute without written permission.
9. Privacy
Your use of our services and website is also governed by our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the courts located in Miami-Dade County, Florida.
11. Changes to Terms
We may update these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the new Terms.
